When registering an account for the Newsletter service in the Online Store, the Client provides the following data: – email address; – name. When placing an order in the Online Store, the Client provides the following data: – email address, – address data: postal code and city, country, street, house/apartment number; – name and surname; – phone number. Entrepreneurs provide the above data and additionally: – name of the Entrepreneur’s company; – NIP number. 1. When using the Online Store, additional information may also be collected, including: IP address assigned to the Client’s computer or external IP address of the Internet provider, domain, type of browser, access time, type of operating system. 2. Navigation data may also be collected from Clients, including information about links and references they decide to click on or other activities performed in our Online Store. Legal basis – legitimate interest – Art. 6 para. 1 lit. f GDPR, enabling better use of services provided electronically. 3. For the purpose of establishing, pursuing and enforcing claims, some personal data provided by the Client while using the functionality may also be processed, including: name, surname, data concerning the use of services, if claims arise from the way the Client uses the services, other data necessary to prove the existence of the claim, including the size of damage suffered. 4. Legal basis – legitimate interest – Art. 6 para. 1 lit. f GDPR, consisting in establishing, pursuing and enforcing claims and defending against claims in proceedings before courts and other state bodies. 5. Personal data collected by the Controller is voluntarily provided to him, in connection with concluded sales contracts, or also providing services through the Online Store, with the reservation that failure to provide specific data in forms during Registration prevents Registration and creation of a Client Account, and in the situation of placing an order without registering a Client Account, will prevent placing and fulfilling the order.

Recipients of personal data

Recipients of your personal data will be: 1. Personnel authorized by the Controller, 2. Entities processing personal data on behalf of the Controller to fulfill the purposes for which this data is collected (in particular entities providing IT solutions and IT and technical support services). These entities must have access to data to perform their duties. These entities will have access to personal data only to the extent necessary to carry out their tasks. 3. Public authorities and entities performing public tasks or acting on behalf of public authorities, to the extent and for purposes arising from generally applicable law.

To whom we may transfer your data and how long they are stored

1. The catalog of recipients of Personal Data processed by the Controller results primarily from the scope of services used by the Client. Client’s personal data is transferred to service providers used by the Controller in running the Online Store. The Controller’s service providers to whom personal data is transferred, depending on contractual arrangements and circumstances, are subject to the Controller’s instructions regarding the purposes and methods of processing this data – processors – or independently determine the purposes and methods of their processing – controllers.

 2. Processors – The Controller uses suppliers who process personal data exclusively on the Controller’s instructions and these include providers of hosting or ICT services, accounting services, providing marketing systems, systems for analyzing traffic in the Online Store, systems for analyzing the effectiveness of marketing campaigns, companies executing marketing campaigns, companies servicing software. 3. Controllers – The Controller also uses suppliers who do not act exclusively on his instructions and independently determine the purposes and methods of using Clients’ personal data. They provide electronic payment services and banking services. 4. Location – Service providers are based in Poland and in other countries of the European Economic Area (EEA). 5. Clients’ personal data is stored: – in a situation where the basis for processing personal data is consent given for this purpose, the Client’s personal data is processed by the Controller until the consent is withdrawn. After its withdrawal, personal data is stored for a period corresponding to the limitation period for claims that the Controller may raise and that may be raised against him. Unless a special provision states otherwise, the limitation period is 10 years, and for claims for periodic benefits and claims related to conducting business activity 3 years. – in a situation where the basis for data processing is contract performance, then the Client’s personal data is processed by the Controller for as long as necessary to perform the contract. After this time, personal data is processed for a period corresponding to the limitation period for claims. Unless special provisions state otherwise, the limitation period is 10 years, for claims for periodic benefits and claims related to conducting business activity 3 years. – in the case of making a purchase in the Online Store, personal data may be transferred, depending on the Client’s choice, to the following entities, in order to deliver products ordered in the Online Store: Poczta Polska, DPD, DHL, InPost – in case the Online Store Client chooses payment through the PayU payment system, his personal data is transferred to the extent necessary for payment processing to PAYU S.A. with its registered office in Poznań (60-166), ul. Grunwaldzka 182, entered in the register of entrepreneurs maintained by the District Court Poznań-Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register under number KRS 0000274399. 6. The Controller also processes data for the purpose of promoting its own services and goods, including sending the User electronic information (email) about available assortment. This data is processed by the Controller based on Art. 6 para. 1 lit f) GDPR (the basis for processing here is the legitimate interest of the controller). 7. Navigation personal data may be used to provide Clients with better service, statistical data analysis and adapting the Online Store to Clients’ preferences and for administering the Online Store. 8. In case the Client chooses the Newsletter subscription service, the Controller will send information to his email address or SMS messages to his mobile phone, containing commercial information about promotions, discounts, new products available in his Online Store. 

9. In case of directing a request for data disclosure to the Controller, he will disclose personal data to authorized state bodies, in particular organizational units of the Prosecutor’s Office, Police, President of the Personal Data Protection Office, President of the Office of Competition and Consumer Protection or President of the Electronic Communications Office.

Can your personal data be transferred outside the European Economic Area?

Due to the fact that the Controller uses the Google Analytics tool, personal data may be transferred outside the European Economic Area. In connection with transferring data outside the EEA, the Controller has ensured to use only suppliers providing guarantees of a high degree of personal data protection. These guarantees result in particular from suppliers’ participation in the “Privacy Shield” program established under Commission Implementing Decision (EU) 2016/1250 of 12 July 2016 on the adequacy of protection provided by the EU-U.S. Privacy Shield.

Personal data storage period

The data processing period is related to the purposes and bases of their processing, therefore: 1. data processed on the basis of statutory requirements will be processed for the time during which legal provisions require data storage; 2. data processed for the purpose of concluding and performing a contract will be processed for the period necessary for its performance and settlement, which may be extended in appropriate cases by the limitation period for civil law claims. 3. data processed on the basis of the Controller’s legitimate interest will be processed until effective objection is filed or this interest ceases, e.g., data processed for the purpose of pursuing or defending against claims will be processed for a time equal to the limitation period for these claims. 4. data processed on the basis of consent will be processed until consent is withdrawn. 

5. personal data processed for recruitment purposes will be stored until the end of the recruitment in which you participate. In case of additionally expressed consent to use data for future recruitment purposes, your data will be stored for 9 months.

Is providing your personal data your obligation?

Providing your personal data is voluntary but necessary to achieve the goal you want to achieve, including e.g., using the service, concluding a contract, responding to your inquiry or issue raised by you. The Controller indicates that providing personal data specified in Art. 22(1) of the Labor Code by a candidate is mandatory in light of applicable labor law provisions. Failure to provide them will result in inability to participate in the conducted recruitment process. Providing personal data by a candidate to a scope broader than resulting from Art. 22(1) of the Labor Code is voluntary. The Controller declares that failure to provide such data cannot be the basis for unfavorable treatment of a person applying for employment, and also cannot cause any negative consequences for them, especially cannot constitute a reason justifying refusal of employment.

Your rights

1. You have the right to request access to your personal data, their correction, deletion or restriction of processing, as well as the right to data portability.
2. If the processing of your personal data is based on the Controller’s legitimate interest, you have the right to object to the processing of your personal data at any time for reasons related to your particular situation.
3. If the legitimate interest is based on conducting direct marketing activities, you have the right to object to the processing of your personal data for such marketing activities at any time, without the need to justify your decision.
4. You have the right to withdraw consent at any time, without affecting the lawfulness of processing carried out on the basis of consent before its withdrawal.
5. You have the right to lodge a complaint with a supervisory authority, i.e., the President of the Personal Data Protection Office. Requests to exercise your rights can be submitted to the contact details provided at the beginning.

Przedsiębiorcy podają dane powyższe oraz dodatkowo: – nazwę firmy Przedsiębiorcy; – numer NIP. 1. Podczas korzystania ze Sklepu Internetowego mogą być również pobierane dodatkowe informacje, w tym: adres IP przypisany do komputera Klienta lub zewnętrzny adres IP dostawcy Internetu, domena, rodzaj przeglądarki, czas dostępu, typ systemu operacyjnego. 2. Od Klientów mogą być również pobierane dane nawigacyjne, w tym informacje o linkach i odnośnikach, w które zdecydują się kliknąć lub innych czynnościach wykonywanych w naszym Sklepie Internetowym. Podstawa prawna – prawnie uzasadniony interes – art. 6 ust. 1 lit. f RODO, umożliwiający lepsze korzystanie z usług świadczonych drogą elektroniczną. 3. Dane osobowe zbierane przez Administratora są mu dobrowolnie podawane, w związku z zawieranymi umowami sprzedaży, czy także świadczeniem usług za pośrednictwem Sklepu Internetowego, z tym zastrzeżeniem, że niepodanie określonych w formularzach danych w procesie Rejestracji uniemożliwia Rejestrację i założenie Konta Klienta, zaś w sytuacji składania zamówienia bez Rejestracji Konta Klienta, uniemożliwi złożenie i realizację zamówienia.

Państwa dane osobowe będą wykorzystywane do podejmowania zautomatyzowanych decyzji, w tym profilowania.

Odbiorcy danych osobowych

Odbiorcami Państwa danych osobowych będą: 1. Upoważniony do tego personel Administratora, 2. Podmioty przetwarzające dane osobowe na zlecenie Administratora dla wypełnienia celów, dla jakich dane te są zbierane (w szczególności podmioty dostarczające rozwiązania IT oraz świadczące usługi IT i wsparcia technicznego). Podmioty te muszą mieć dostęp do danych, aby wykonywać swoje obowiązki. Podmioty te będą miały dostęp do danych osobowych tylko w zakresie niezbędnym do realizacji spoczywających na nich zadań. 3. Organy władzy publicznej oraz podmioty wykonujące zadania publiczne lub działające na zlecenie organów władzy publicznej, w zakresie i w celach, które wynikają z przepisów powszechnie obowiązującego prawa.

Komu możemy przekazywać Twoje dane oraz jaki czas są przechowywane

1. Katalog odbiorców Danych Osobowych przetwarzanych przez Administratora wynika przede wszystkim z zakresu usług z jakich korzysta Klient. Dane osobowe Klienta przekazywane są dostawcom usług, z których korzysta Administrator przy prowadzeniu Sklepu Internetowego. Dostawcy usług Administratora, którym przekazywane są dane osobowe, w zależności od uzgodnień umownych i okoliczności, podlegają poleceniom Administratora co do celów i sposobów przetwarzania tych danych – podmioty przetwarzające – lub samodzielnie określają cele i sposoby ich przetwarzania – administratorzy.

 2. Podmioty przetwarzające – Administrator korzysta z dostawców, którzy przetwarzają dane osobowe wyłącznie na polecenie Administratora i są to między innymi dostawcy usług hostingu lub usług teleinformatycznych, usługi księgowe, dostarczający systemy do marketingu, systemy do analizy ruchu w Sklepie Internetowym, systemy do analizy skuteczności kampanii marketingowych, firmy wykonujące kampanie marketingowe, firmy serwisujące oprogramowanie. 3. Administratorzy – Administrator korzysta również z dostawców, którzy nie działają wyłącznie na jego polecenie i sami ustalają cele i sposoby wykorzystania danych osobowych Klientów. Świadczą oni usługi płatności elektronicznych oraz usługi bankowe. 4. Lokalizacja – Dostawcy usług mają siedzibę w Polsce oraz w innych krajach Europejskiego Obszaru Gospodarczego (EOG). 5. Dane osobowe Klientów przechowywane są: – w sytuacji, gdy podstawą przetwarzania danych osobowych jest przekazywana na to zgoda, dane osobowe Klienta przetwarzane są przez Administratora do chwili, gdy zgoda zostanie odwołana. Po jej odwołaniu dane osobowe są przechowywane przez okres odpowiadający okresowi przedawnienia roszczeń jakie może podnosić Administrator i jakie mogą być podnoszone wobec niego. Jeżeli przepis szczególny nie stanowi inaczej, termin przedawnienia wynosi 10 lat, a dla roszczeń o świadczenia okresowe oraz roszczeń związanych z prowadzeniem działalności gospodarczej 3 lata. – w sytuacji, gdy podstawą przetwarzania danych jest wykonanie umowy, wówczas dane osobowe Klienta przetwarzane są przez Administratora tak długo, ile jest to niezbędne do wykonania umowy. Po tym czasie dane osobowe są przetwarzane przez okres odpowiadający okresowi przedawnienia roszczeń. Jeśli przepisy szczególne nie stanowią inaczej, termin przedawnienia wynosi 10 lat, dla roszczeń o świadczenia okresowe i roszczeń związanych z prowadzeniem działalności gospodarczej 3 lata. – w sytuacji dokonania zakupu w Sklepie Internetowym, dane osobowe mogą być przekazywane, w zależności od wyboru Klienta, poniższym podmiotom, w celu dostarczenia zamówionych w Sklepie Internetowym produktów: Poczta Polska, DPD, DHL, InPost – w przypadku, gdy Klient Sklepu Internetowego wybierze płatność poprzez system płatności PayU jego dane osobowe są przekazywane w zakresie niezbędnym dla realizacji płatności spółce PAYU S.A. z siedzibą w Poznaniu (60-166), ul. Grunwaldzka 182, wpisanej do rejestru przedsiębiorców prowadzonego przez Sąd Rejonowy Poznań-Nowe Miasto i Wilda w Poznaniu, Wydział VIII Gospodarczy Krajowego Rejestru Sądowego pod numerem KRS 0000274399. 6. Administrator przetwarza dane również w celu promocji własnych usług i towarów w tym przesyłania Użytkownikowi elektronicznej informacji (mail) o dostępnym asortymencie. Dane te są przetwarzane przez Administratora w oparciu o art. 6 ust. 1 lit f) RODO (podstawą przetwarzania jest tutaj prawnie uzasadniony interes administratora). 7. Dane osobowe nawigacyjne mogą być wykorzystywane w celu zapewnienia Klientom lepszej obsługi, analizy danych statystycznych i dostosowania Sklepu Internetowego do preferencji Klientów oraz do administrowania Sklepem Internetowym. 8. W przypadku, gdy Klient wybierze usługę subskrypcji Newslettera, Administrator będzie wysyłał informacje na jego adres e-mail lub wiadomości SMS na jego telefon komórkowy, zawierające informacje handlowe o promocjach, obniżkach, nowych produktach dostępnych w jego Sklepie Internetowym. 

9. W przypadku skierowania do Administratora żądania udostępnia danych, udostępni on dane osobowe uprawnionym organom państwowym, w szczególności jednostkom organizacyjnymProkuratury, Policji, Prezesowi Urzędu Ochrony Danych Osobowych, Prezesowi Urzędu Ochrony Konkurencji i Konsumentów lub Prezesowi Urzędu Komunikacji Elektronicznej.

Czy Państwa dane osobowe mogą być przekazywane poza Europejski Obszar Gospodarczy?

Z uwagi na to, że Administrator korzysta z narzędzia Google Analytics, dane osobowe mogą być przekazywane poza teren Europejskiego Obszaru Gospodarczego. W związku z przekazywaniem danych poza EOG Administrator zadbał o to, aby korzystać wyłącznie z dostawców dających gwarancje wysokiego stopnia ochrony danych osobowych. Gwarancje te wynikają w szczególności z uczestnictwa dostawców w programie „Tarcza Prywatności” ustanowionym na mocy decyzji wykonawczej Komisji (UE) 2016/1250 z dnia 12 lipca 2016 r. w sprawie adekwatności ochrony zapewnianej przez Tarczę Prywatności UE-USA.

Okres przechowywania danych osobowych

Okres przetwarzania danych jest związany z celami i podstawami ich przetwarzania, w związku z czym: 1. dane przetwarzane na podstawie wymogów ustawowych będą przetwarzane przez czas, w którym przepisy prawa nakazują przechowanie danych; 2. dane przetwarzane w celu zawarcia i realizacji umowy będą przetwarzane przez okres niezbędny do jej realizacji i rozliczenia, co może być w stosownych wypadkach przedłużone o okres przedawnienia roszczeń cywilnoprawnych. 3. dane przetwarzane na podstawie prawnie uzasadnionego interesu Administratora będą przetwarzane do czasu skutecznego złożenia sprzeciwu lub ustania tego interesu, np. dane przetwarzane w celu dochodzenia lub obrony przed roszczeniami będą przetwarzane przez czas równy okresowi przedawnienia tych roszczeń. 4. dane przetwarzane na podstawie zgody będą przetwarzane do momentu cofnięcia zgody. 

5. dane osobowe przetwarzane w celach rekrutacyjnych będą przechowywane do czasuzakończenia rekrutacji, w którym biorą Państwo udział. W przypadku dodatkowo wyrażonej zgody na wykorzystanie danych w celach przyszłych rekrutacji, Państwa dane będą przechowywane przez okres 9 miesięcy.

Czy podanie Państwa danych osobowych jest Państwa obowiązkiem?

Podanie przez Państwa danych osobowych jest dobrowolne jednak niezbędne do realizacji celu, który chcą Państwo zrealizować, w tym do np. korzystania z serwisu, zawarcia umowy, odpowiedzi na Państwa zapytanie lub poruszone przez Państwa zagadnienie. Administrator wskazuje, że podanie przez kandydata danych osobowych wskazanych w art. 22(1) Kodeksu pracy jest obowiązkowe w świetle obowiązujących przepisów prawa pracy. Ich niepodanie będzie skutkowało brakiem możliwości wzięcia udziału w prowadzonym procesie rekrutacji. Podanie przez kandydata danych osobowych w zakresie szerszym niż wynikający z art. 22(1) Kodeksu pracy jest dobrowolne. Administrator oświadcza, że brak podania takich danych nie może być podstawą niekorzystnego traktowania osoby ubiegającej się o zatrudnienie, a także nie może powodować wobec niej jakichkolwiek negatywnych konsekwencji, zwłaszcza nie może stanowić przyczyny uzasadniającej odmowę zatrudnienia.

Twoje prawa

1. Masz prawo żądać dostępu do swoich danych osobowych, ich poprawienia, usunięcia lub ograniczenia przetwarzania, a także prawo do przenoszenia danych.
2. Jeśli przetwarzanie Twoich danych osobowych opiera się na prawnie uzasadnionym interesie Administratora, masz prawo w dowolnym momencie sprzeciwić się przetwarzaniu Twoich danych osobowych z powodów związanych z Twoją konkretną sytuacją.
3. Jeśli prawnie uzasadniony interes opiera się na prowadzeniu działań marketingowych bezpośrednich, masz prawo w dowolnym momencie sprzeciwić się przetwarzaniu Twoich danych osobowych na potrzeby takich działań marketingowych, bez konieczności uzasadniania swojej decyzji.
4. Masz prawo w dowolnym momencie wycofać zgodę, nie wpływając na zgodność z prawem przetwarzania, którego dokonano na podstawie zgody przed jej wycofaniem.
5. Masz prawo złożyć skargę do organu nadzorczego, tj. Prezesa Urzędu Ochrony Danych Osobowych. Prośby o skorzystanie z przysługujących Ci praw można zgłaszać na podane na początku dane kontaktowe.
